In Nebraska, Connerly’s NCRI (Nebraska Civil Rights Initiative) to amend the State Constitution to prohibit affirmative action programs was approved on November 4, 2008. 58% of voters voted for the initiative, while 42% of voters voted against it. However, ongoing litigation regarding fraudulent signature gathering processes could prevent the amendment from going into effect. The suit was brought in Lancaster County District Court, and the trial was concluded before the election. The judge is expected to rule on the case soon.

Nebraskans United, the coalition that came together in support of affirmative action, brought the suit against the Connerly initiative. The group also ran a campaign to encourage voters to vote no on the Connerly initiative.
